Terms and Conditions of Entry
1. The Competition
1.1. Information on how to enter this Shell Card Online Competition ( ‘Competition’)
forms part of these Terms and Conditions. By participating in the Competition,
Entrants (as defined below) accept these Terms and Conditions.
1.2. To the extent of any inconsistency between these Terms and
Conditions and any other reference to this Competition, these Terms and
Conditions prevail.
1.3. The Promoter is Viva Energy Australia Pty Ltd (ABN 46 004 610 459)
('Promoter'). The Promoter's address
is Level 16, 720 Bourke Street, Docklands, VIC 3008.
2. Who can enter
the Competition?
2.1. Entry to the Competition is open to all residents of Australia who:
a)
are over the age of 18; and
b)
open a new Shell Card account before
31/05/2024 using the codes “ACA, ADA, AMA, APODA, DHAA, FBAA, SNSW, PHF, QSL,
RACP, RANZCP, REIV, APA,”;
c)
are accepted as eligible to
participate by the Promoter
(‘Eligible Entrants’).
2.2.
Employees, and their immediate
families, of the Promoter, associated
agencies and companies, contractors are not eligible to enter this Competition.
Immediate family means any of the following: spouse, ex-spouse, defacto spouse,
child or step child (whether natural or by adoption), parent, step parent,
grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister,
step brother, step sister or 1st cousin.
2.3.
The Promoter, in its absolute
discretion, will determine who is eligible to register and participate in the
Competition.
3. Promotional
Period
The Competition commences on
19/04/2024 at 12:01 AM and
closes 31/05/2024 at 11:59 PM ('Promotional Period').
All times noted in these Terms and Conditions are Australian Eastern Standard
Time. If any draw date (as set out below) falls on a public holiday in
Victoria, that draw will be conducted on the next business day. Entries must be
received by the Promoter prior to the Competition close date and time. For the
purpose of these Terms and Conditions, a ‘business day’ is a day that is not a
Saturday, a Sunday or a public or bank holiday in Melbourne.
d)
To enter the Competition, Eligible
Entrants must, during the Promotional Period, apply for a Shell Card account
with any of the following the promotional codes “ACA, ADA, AMA, APODA, DHAA,
FBAA, SNSW, PHF, QSL, RACP, RANZCP, REIV, APA,”;
4.1. Eligible entrants must also transact a minimum of one (1) times
using their Shell card account once approved.
4.2. As part of the entry process, Eligible Entrants must consent to
receiving communications from the Promoter regarding offers, promotions, goods
and services and other promotional materials.
5. Prize Draw
5.1. The Promoter is offering Eligible Entrants the chance to win one
(1) prize. The prize consists of one (1)
$1000 Coles Express Fuel Voucher
5.2.
The prize draw will take place via
a certified system randomdraws.com.au on 04/06/2024 at 11:00am at 720 Bourke St
Docklands, VIC 3008 (‘Prize Draw’).
5.3.
The prize winner will be notified in
writing by email within two (2) business days of the draw. Their name will also
be published on 08/06/2024 at
www.shell.com.au/business-customers/promotions-and-offers/competition-winners.html. An email notifying the prize winner will be
sent to the email associated to the relevant Shell Card account.
6.
Prizes on offer
6.1.
The total prize pool is valued at AU$1000
(Including GST), as at 16/04/2024.
6.2.

7.
Other matters relating to the Competition
7.1.
The winning Entrant must, in accordance with the directions of the
Promoter, claim their prize in the time specified by the Promoter. The Promoter
accepts no responsibility should a winner not claim their prize in the required
time, and will not be held responsible in this regard.
7.2.
Prizes are not transferable or exchangeable and cannot be taken as
cash, unless otherwise specified.
7.3.
The Promoter reserves the right, at any time, to verify the
validity of entries and Entrants (including an Entrant’s identity, age, employer,
and place of residence) and reserves the right, in its sole discretion, to
disqualify any individual who the Promoter has reason to believe has breached
any of these Terms and Conditions, tampered with the entry process or engaged
in any unlawful or other improper misconduct calculated to jeopardise fair and
proper conduct of the Competition.
7.4.
Any Entrant found to have used a
third party (including online competition entry site) to enter on their behalf
will have all entries invalidated and any claim they have to any prize will be
invalidated. If such an Entrant is awarded a prize and then found to have
breached this clause, the Entrant must immediately return any prize awarded. The
Promoter has sole discretion to determine if this clause has been breached by
any Entrant. The Promoter reserves the right to request whatever documentation
it deems necessary to confirm if the Entrant has breached this clause. An Entrant
must provide any requested documentation to the Promoter upon request. The
Promoter reserves the right to disqualify any Entrant who provides false
information or who seeks to gain an unfair advantage or to manipulate this Competition.
7.5.
Any Entrant found to have entered incorrect
contact details, including incorrect email contact details, will have all
entries invalidated and any claim to any prize will be invalidated. If such an Entrant
is awarded a prize and then found to have breached this clause, the Entrant
must immediately return any prize awarded. The Promoter has sole discretion to
determine if this clause has been breached by any Entrant. The Promoter
reserves the right to request whatever documentation it deems necessary to
confirm if the Entrant has breached this clause. An Entrant must provide any
requested documentation to the Promoter upon request.
7.6.
If the prize is unavailable, for
whatever reason, the Promoter reserves the right to substitute the prize for a
prize of equal or greater value, subject to State and Territory legislation.
Cash will not necessarily be awarded as a substitute. It is a condition of
accepting the prize that the winner must comply with all the conditions of use
of the prize and prize supplier's requirements. Each prize must be taken as stated and no
compensation will be payable if a winner is unable to use the prize as stated.
7.7.
The Promoter reserves the right to
conduct a redraw in the event that an Entrant, claiming to be a winner, is unable
to satisfy these Terms and Conditions or has breached these Terms and
Conditions. Any redraw will take place on 11/06/2024 at 10am at 720 Bourke St
Docklands, VIC 3008, subject to the directions of any regulatory authority.
Winners, if any, will be notified in writing by email within two (2) business
days of the draw and their name will also be published on 13/06/2024 at
www.shell.com.au/business-customers/promotions-and-offers/competition-winners.html.
7.8.
If for any reason a winner does not use, redeem or take a prize
(or an element of a prize) by or at the time stipulated by the Promoter, then
the prize (or that element of the prize) will be forfeited and will not be
redeemable for cash.
7.9.
Entrants who win a prize consent to the Promoter using their name,
likeness, image and/or voice (including photograph, film and/or recording of
the same), in any media, for an unlimited period and without remuneration, for
the purpose of promoting this Competition (including any outcome), and
promoting any products manufactured, distributed and/or supplied by the
Promoter.
7.10. The Promoter's decision in relation to any aspect of the Competition
is subject to State and Territory legislation but also final and binding on
each person who enters. No correspondence will be entered into. No
responsibility is accepted for late, lost or misdirected entries.
7.11. Errors
and omissions may be accepted at the Promoter's discretion. Failure by the
Promoter to enforce any of its rights at any stage does not constitute a waiver
of those rights. The Promoter's legal rights to recover damages or other
compensation from such an offender are reserved.
7.12. If
this Competition is interfered with in any way or is not capable of being
conducted as reasonably anticipated due to any reason beyond the reasonable
control of the Promoter (including but not limited to technical difficulties,
unauthorised intervention or fraud), the Promoter reserves the right, in its
sole discretion, to the fullest extent permitted by law:
a)
to disqualify any Entrant; or
b)
subject to any written directions from a regulatory authority, to
modify, suspend, terminate or cancel the Competition, as appropriate.
7.13. Any
cost associated with entering the Competition, or accessing the Website is the
Entrant’s responsibility and is dependent on the Internet service provider
used.
7.14. The Promoter (subject to State and Territory legislation) reserves
the right to amend, cancel or suspend this Competition if an event beyond the
control of the Promoter corrupts or affect the administration security,
fairness, integrity or proper conduct of this Competition. The Promoter will
disqualify any individual who has tampered with the entry process or any other
aspect of this Competition. In particular, computer generated entries and the
use "scripting" is not permitted and will not be accepted.
7.15. All entries and any copyright or other intellectual property
rights subsisting in the entries become and remain the property of the Promoter
who may publish or cause to be published any of the entries received.
7.16. Prize-winners are advised that tax
implications may arise from their prize winnings and they should seek
independent financial advice prior to acceptance of that prize.
8.
Liability
8.1.
Nothing in these Terms and
Conditions limits, excludes or modifies or purports to limit, exclude or modify
the statutory consumer guarantees as provided under the Competition and
Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC
Act or similar consumer protection laws in the State and Territories of Australia
('Non-Excludable Guarantees').
8.2.
Except for any liability that
cannot by law be excluded, including the Non-Excludable Guarantees, the
Promoter (including its respective officers, employees and agents) is not
responsible for and excludes all liability (including negligence), for any
personal injury; or any loss or damage (including loss of opportunity); whether
direct, indirect, special or consequential, arising in any way out of:
a)
any technical difficulties or
equipment malfunction (whether or not under the Promoter's control);
b)
any theft, unauthorised access or
third party interference;
c)
any entry or prize claim that is
late, lost, altered, damaged or misdirected (whether or not after their receipt
by the Promoter) due to any reason beyond the reasonable control of the
Promoter;
d)
any variation in prize value to
that stated in these Terms and Conditions;
e)
any tax liability incurred by a
winner or Entrant; or
f)
use of a prize.
8.3.
The Promoter (including its'
officers, employees and agents) excludes all liability for any loss (including,
without limitation, indirect, special or consequential loss or loss of profits
or opportunity), expense, damage, personal injury or death which is suffered or
sustained (whether or not arising from any person's negligence) in connection
with this Competition including taking or using a prize, except for any
liability which cannot be excluded by law (in which case that liability is
limited to the minimum allowable by law), including the Non-Excludable
guarantees. Any change in value of the prize occurring between the publishing
date and date the prize is claimed is not the responsibility of the Promoter.
9.
Privacy
9.1.
The Promoter collects personal
information in order to conduct the Competition and may, for this purpose,
disclose such personal information to third parties, including but not limited
to agents, contractors, service providers, prize suppliers and, as required, to
Australian regulatory authorities.
9.2.
Entry is conditional on
individuals providing their personal information.
9.3.
The Promoter will collect, store,
use and disclose personal information as set out in its privacy policy, which
can be viewed at https://www.vivaenergy.com.au/contact-us/privacy-policy ('Privacy Policy').
9.4.
In addition to any use that may be
outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite
period, unless otherwise advised, use the personal information for promotional,
marketing, publicity, research and profiling purposes, including sending
electronic messages or telephoning individuals. The Privacy Policy also
contains information about how individuals may opt out, access, update or
correct their personal information, how individuals may complain about a breach
of the Australian Privacy Principles or any other applicable law and how those
complaints will be dealt with. The Promoter will not disclose personal
information overseas. All entries become the property of the Promoter.
